It was never covered by a patent as its Japanese inventor thought it should benefit the world. Imagine that. Masimo wanted to profit and filed many patents on this, most of which are now invalidated due to obviousness and prior art. Masimo went after Apple as they wanted to launch their own smart watch.. Apple filed against them for design infringement. The validity of that aside, this a grudge match between a million dollar company and a billion dollar company. The market has already decided who will win as Masimo share price has dropped by 50% since they started their suit.
